I. Introduction

Welcome to the Titans of Cronos ("Titans of Cronos" or "We"). These Terms and Conditions ("Terms") govern your access to and use of the Titans of Cronos website (ToC-Swap), game servers, discord servers, and related services (collectively, the "Platform"), including but not limited to the use of Charon NFTs and participation in our ecosystem. By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must refrain from using the Platform.

II. Use of Platform/Security

Digital Wallet Integration: To participate in the Titans of Cronos ecosystem, including playing games, managing NFTs, or engaging in transactions, you must connect a supported digital wallet. You are solely responsible for maintaining the security of your wallet and its contents. Transactions on the Platform are executed and verified via blockchain technology, which we cannot alter or obscure. Your public wallet address may be visible when engaging in transactions. Please ensure you conduct transactions in line with your desired level of privacy.

Platform Liability: Titans of Cronos is not liable for any claims or damages arising from your transactions or activities on the Platform. This includes unauthorized access to your wallet or user account. We reserve the right to disclose information as required by law or to satisfy legal processes.

NFT Ownership: You retain full ownership of any NFTs you purchase or acquire on the Platform. However, failure to comply with these Terms may result in restrictions on your ability to use or transfer your NFTs on the Platform. Some NFTs may be restricted from visibility or use on the Platform due to legal or other limitations.

III. E-Signature Agreement

By using the Platform, you agree that any electronic signature or digital authentication associated with blockchain transactions has the same legal force as a physical signature. This includes any process intended to authenticate a transaction, such as checking a box or using a digital key.

IV. Blockchain Knowledge

Certification of Knowledge: By using the Platform, you certify that you have sufficient knowledge of blockchain technology, including NFTs, digital wallets, and smart contracts. You understand the risks associated with these technologies, including the potential loss of assets. You also acknowledge the importance of securing your digital assets using proper security measures, such as cold storage for valuable NFTs.

Gas Fees: Transactions on the blockchain require payment of "Gas" fees, which are used to process and confirm transactions. You are responsible for paying any Gas fees associated with transactions on the Platform. These fees are non-refundable and may vary depending on network congestion. KingCoin ($KC): KingCoin is a community token of Titans of Cronos and has no intrinsic value. Users can swap their rugged NFTs in for $KC. Trading $KC is entirely at your own risk. Titans of Cronos is not responsible for any losses that may occur as a result of trading or holding $KC.

V. User Account and User Representations

User Account: To access certain features of the Platform, you may need to create a user account linked to your digital wallet. You are responsible for maintaining the security and confidentiality of your account information, including your wallet's seed phrase and private key. You are also responsible for all activities conducted through your account.

User Representations: By creating an account and using the Platform, you represent and warrant that:

• You are legally competent to form a binding contract and have reached the age of majority in your jurisdiction.

• You are not subject to any legal restrictions that would prevent you from using the Platform or participating in blockchain transactions.

• You are not using the Platform for competitive purposes against Titans of Cronos or any of its affiliates.

VI. Prohibited Use/Conduct

You agree to refrain from using the Platform in any manner that violates applicable laws or these Terms. This includes but is not limited to:

• Engaging in fraudulent, deceptive, or illegal activities.

• Using bots or automated systems to interact with the Platform.

• Attempting to hack, reverse engineer, or otherwise tamper with the Platform or its underlying technology.

• Using the Platform for spamming, phishing, or other malicious activities.

• Trading or selling NFTs that you do not own or have the legal right to transfer.

VII. Intellectual Property Notice

All intellectual property associated with the Titans of Cronos Gaming Guild, including logos, branding, and Platform content, is owned by Titans of Cronos. You may not use, reproduce, or distribute any content from the Platform without our express written permission.

VIII. Children Under the Age of 18

The Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If you are under 18, you must not use the Platform.

IX. Indemnification

You agree to indemnify and hold harmless Titans of Cronos and its affiliates from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms. This includes any legal fees incurred in defending against such claims.

X. Disclaimers

The Platform is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the security or availability of the Platform, and we are not liable for any loss or damage arising from its use.

XI. Limitation of Liability

To the fullest extent permitted by law, Titans of Cronos is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability to you for any claims related to the Platform is limited to the amount of fees you have paid to us, if any.

XII. Dispute Resolution

Choice of Law: These Terms are governed by the laws of Florida, without regard to its conflict of law principles.

Arbitration: Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration, conducted in Florida under the rules of the American Arbitration Association. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.

XIII. Modifications

We may update these Terms at any time. If we make significant changes, we will notify you through the Platform. Your continued use of the Platform after such changes take effect constitutes your acceptance of the new Terms.
